You agree to not use the website for illegal purposes. You will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the website. You also agree to not compromise the security of the website or attempt to gain access to secured areas or sensitive information in other than the allowed ways.
MODIFICATION
We reserve the right to change any part of this agreement or the website with or without notice, or with or without cause; and your use of the website will be deemed as acceptance of this agreement. We therefore advise users to regularly check these terms and conditions. We have complete discretion to modify or remove any part of this website without any warning or any liability arising from such action.
LIMITATION OF LIABILITY
You hereby agree to defend, indemnify, and hold us or our affiliates harmless from and against any and all liabilities, damages, claims, actions, costs or expenses, including, without any limitation, legal fees, in connection with or arising from your breach of any of our terms or your use of the website or our products and services.
We will under no circumstance be liable for direct or indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use, or inability to use, of the website.
Nothing within these terms shall cause any liability for us out of death or personal injury arising as result of negligence. You agree to be fully responsible and liable for any claim, expense, liability, loss, cost, including legal fees incurred by us arising from any infringement of these terms and conditions.
We may, if deemed to be necessary, participate in defense of any claim or action or any negotiations for potential or actual settlement. No settlement can be made without our prior express written approval. We reserve the right, with or without notice, with or without cause, to bring collective or sole defense or control to any claim or action.
This website or the materials or products on this website are provided "as is", or without warranties or guarantees, whether express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim warranties, express or implied, including but not limited to, implied warranties of merchantability or fitness for a particular purpose or non-infringement. We do not represent or warrant that the functions contained in this website will be uninterrupted or free of error, that defects will be corrected, or that this website or server are free of harmful components.
We cannot accept responsibility for any loss or damage to property belonging to, or for any personal injury incurred by, attendees at our seminars, coaching, corporate training or such events, whether within a venue or otherwise. The special rules appertaining to a venue must be obeyed independently of these terms without conflict.
SEVERANCE
If any provision of these and other terms on the website is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force. Salvatory clause is in force; estoppel is void.
GOVERNING LAW AND JURISDICTION
These terms, this website and all services and products related and their use shall be governed by the laws of England. Any user of the website must irrevocably submit to be bound exclusively by the jurisdiction of the courts in England; this notwithstanding the jurisdiction if based elsewhere.
WEBSITE CONDUCT
You understand that, except for offers by us on this website, the products or services are available for your personal, non-commercial, non-resale use only.
You represent, warrant and agree that no materials of any kind submitted through you or otherwise posted, transmitted, or shared by you on or through this website will violate or infringe upon a right of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.
EVENT CONDUCT
You understand that, during live sessions of service or products, interruptions shall be kept to minimum, to respectful comment, to nurturing the progress, to enhancement of learning, to overall well being, to heightening of happiness; but in no case shall any behavior cause adverse effect or constitute antisocial behavior.
Because event processes build on group work or class participation, full attendance is expected throughout.
We reserve a right to refuse admission on account of health and safety, environmental or security concerns at our sole discretion and to make changes to advertised programs owing to any and all circumstances beyond reasonable control.
We reserve a right to refuse admission to or remove anyone from events with or without reason and with or without cause.
Individuals or persons must be 21 or over to attend our events. We cannot guarantee that latecomers will be admitted. The language of communication shall be English, and such must be ensured to be understood by the attendee solely. Please wear your name badge at all times.
ORDERS; PAYMENT
When you submit an order to us via the website or other methods, you are agreeing to be bound to your commitment to pay for that order. We reserve the right, with or without notice, with or without cause, to not accept or process your order, or to cancel it, for any reason. Our order and payment process necessitates validation, authorization, examination and confirmation through a third party, e.g. the credit card issuer or the electronic payment system used. Prices are subject to change without notice or without cause at any time. We accept only the following currencies: GBP--Great British Pound; EUR--Euro; CHF--Swiss Franc; USD--United States Dollar; HKD--Hong Kong Dollar. Prices may be quoted in any local currency. However, you are free to pay in any currency as long as the equivalent arrives converted with us in our accepted currency residually.
Please note that you must register for any seminar, event, training or coaching in advance; and that only after your application is accepted and approved by us; and paid for by you in full; your place may be reserved, if space is still available. Registration in person before or at the event may not be possible. Online registration is preferred and standard.
Registration is accepted on a first come basis. If capacity is reached, registration for the event will be closed. Space is limited; there is no standing attendance.
Bookings are at the sole discretion of us; issued or assigned only by us and cannot be transferred without our approval and a fee to be determined. Participants, especially groups, shall check reservations upon receipt and notify us immediately of any discrepancies.
Seminars, coaching, corporate training and such events and their agenda, schedule or any other organizational part are at the sole discretion of the organizer, course director or other responsible individual and may be subject to change with or without cause or reason. We will, however, always attempt to execute the original and advertised plan and attempt to inform you as soon as possible of any changes, should they ever occur.
CANCELLATION; REFUND
In general, fees are non-refundable, non-transferrable, and cannot be exchanged. However, cancellations, refunds or other changes are subject to a refund schedule which may be detailed for each occasion and if so will supersede the following refund schedule:
Fees below or at GBP 80 per person are not refundable under any circumstances. Any part of any fee above GBP 80 per person can be refunded according to the following detailed procedure.
Coaching/corporate training/seminar event services refunds are based on
received cancellations and are either:
75% on or before the 45th day before the event; or
50% on or before the 30th day before the event; or
25% on or before the 15th day before the event.
After that, refunds cannot and will not be issued.
Scheduled cost/booked travel/other agreed-upon expenses or fees are
non-refundable at any time and must be paid in advance.
Special provision for HKMA members as follows. If the 17-DEC-2008 GLS is rescheduled or cancelled, HKMA members paid by cheque shall receive a full refund without penalty. Furthermore, HKMA members shall substitute without a fee, but must ensure payments stay with HKMA.
The time frames are applicable in any case, even if bookings take place only a few days before the start date of coaching/corporate training/seminar events.
Non-attendance counts as cancellation on the day and that means no refund will be made at all under any circumstances for any reason, including medical emergencies. We cannot make exceptions to this policy. Refunds shall be made within 30 business days after the event concludes.
If you wish to transfer your reservation/place to another person, we will consider your intent at our sole discretion, and if granted, there is a 25% transfer fee. However, the substitute shall be of similar level/seniority/profile/education in order to maintain maximum audience consistency.
If you wish to transfer to another seminar/event, please book the new event and cancel the old one.
Please let us know immediately or at your convenience of any changes you may wish to make to your bookings. All cancellations and transfers must be received in writing.
Even though we attempt all in our powers to ensure events take place as scheduled, we may have to cancel an event on short notice, e.g. for reasons beyond our control, illness, natural catastrophe or else. Should an event, in the rare occasion, not take place at all, not even partly, not even with a substitute speaker/director/trainer, not even with a changed agenda/schedule, not even with the offer to a similar event of different date, then the customer is entitled to a full refund of the original amount received by us. No further legal claims can be made; we assume no responsibility for non-refundable costs, e.g. travel expenses, lodging cost, related costs; consequential arrangements, or reimbursement of work absenteeism, or else items, or additional cost incurred by registrant.
We will do all and anything in our powers to ensure all scheduled events take place in the best possible quality and will always work towards highest attendee satisfaction. However, in the rare circumstance, we cannot accept responsibility should any of the trainers not perform due to such causes which are beyond our reasonable control or to the trainer. We hold no responsibility for event cancellations or postponements whether in whole or in part for causes beyond reasonable control.
The registrant/participant/attendee accepts that our decisions in relation to our services, offers, products, the website or such are final, definitive, and binding.
